1. Terms of purchase
By visiting our website and/or placing an order with Ylse Design AB's, org. number 559354-7036, Södra hamnvägen 13, 115 41 Stockholm (“Ylse” “we” “us”), or in any other way communicate with us, you engage in our service (“Service”) and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content, as well as customers who purchase from us.
2. Orders and products
Unless specifically stated otherwise, all Ylses products are bespoke and custom-made according to your specifications. This means that we will produce the product upon your request and upon your measurements. You are responsible to ensure that the measurements provided to Ylse are correct. Since our products are handmade, they may vary slightly in appearance. We strive to accurately depict our products, but variations are part of the handmade nature. Ylse has made every effort to display as accurately as possible the colors and images of our products and fabrics. However, we cannot guarantee that your computer monitor's display of any color or any physical fabric sample will be accurate. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Except as expressly stated herein, products are provided “as is” without any warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
We reserve the right to refuse service to any person, geographic region or jurisdiction for any reason at any time. We may exercise this right on a case-by-case basis. Please note that Ylse does not guarantee that all products presented on the website are in stock or available for purchase. Ylse reserves the right to stop selling any product. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We reserve the right to cancel any order if export would violate applicable export control laws or sanctions regulations.
You may purchase products on the site for personal use only and not for resale. By placing an order on the site you certify that you are purchasing the product for your own personal use, or as a gift for a friend and not for resale and that you accept our Terms and Conditions, unless you are a registered B2B customer.
3. Prices and payment
All prices are quoted in Swedish Krona (SEK), unless otherwise stated. For Swedish and EU customers, all prices include VAT. For customers outside of the EU, prices are quoted excluding VAT and are exclusive of import duties and customs fees. Please be aware of the applicable import duties, restrictions, or required permits for your country as you will be responsible for these at the time of delivery.
Payment is made via the payment options offered on Ylse's website, by invoice or by payment option offered by Ylse. For bespoke products, the payment must be received before we start producing the product.
Prices for our products are subject to change without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. All quoted prices for bespoke products are valid for 10 days, we reserve the right to change prices quoted for any reason.
3. Delivery and shipping
All our products are made to order according to the customer’s specifications. We aim to deliver your bespoke furniture within the delivery time specified by Ylse, either directly to you or via our website. However, delivery times may be subject to delays due to the delicate and handmade production process or unforeseen circumstances. E.g. we are not responsible for delays caused by customs, postal services, or any of our suppliers, including but not limited to fabric suppliers.
International shipping
We ship to Sweden, EU, UK, Norway and other international regions. If there is no shipping option available for your destination, please email us at hello@ylsedesign.se. Delivery costs will be added and specified when ordering. Shipping costs and delivery times will vary based on your location.
Customers are responsible for any customs fees, import duties, taxes, or other charges that may be applied by their country’s customs authority. If the customer refuses to pay these charges, fails to collect the shipment, or if the shipment is returned to us for any reason outside of our control (including refusal to accept delivery), the customer will be responsible for all return shipping costs, as well as any additional fees incurred. These costs will be deducted from any potential refund, if applicable.
Risk of loss and damage passes to the customer upon delivery to the carrier, unless otherwise agreed in writing. If delivery cannot be completed due to customer circumstances, Ylse reserves the right to charge storage fees.
We reserve the right to suspend or cancel deliveries to regions affected by political instability, armed conflict, sanctions, or other safety concerns without liability.
Customs, Import Duties and Delays
For deliveries outside the European Union, the customer acts as the importer of record and is solely responsible for complying with all applicable import laws and regulations in the destination country.
The customer is responsible for:

Payment of all customs duties, import taxes, VAT, tariffs, clearance fees, and any other governmental charges;

Providing any documentation required by customs authorities;

Ensuring that the product may legally be imported into the destination country.
Ylse shall not be liable for delays, storage fees, inspections, holds, confiscation, destruction, or other actions taken by customs authorities or other governmental bodies.
If a shipment is delayed, held, returned, destroyed, or refused due to:

The customer’s failure to pay import duties or taxes;

The customer’s failure to provide required documentation;
-
Local import restrictions;
-
Governmental decisions, sanctions, embargoes, or regulatory actions;
the customer shall bear all resulting costs, including but not limited to return shipping, storage charges, administrative fees, and any loss in value of the product.
If a shipment is returned to Ylse for reasons beyond our control, we reserve the right to deduct all incurred costs from any potential refund. For bespoke or custom-made products, no refund will be issued.
Ylse reserves the right to cancel or suspend delivery if export or import would violate applicable laws, sanctions, or export control regulations.
5. Promotions
Promotion codes are limited to one time per customer and cannot be combined with other offers, if not otherwise explicitly stated. Promotion codes and offers are only valid within the explicitly set time or as far as we have stock and not applicable to previously placed orders.
6. Gift vouchers
Gift cards are valid until the voucher expires. Unused gift cards cannot be refunded or used on purchases after the expiry date. Gift cards cannot be redeemed for cash. If you have been offered a gift card, the terms agreed in writing between you and Ylse in relation to that gift card will apply.
7. Right of withdrawal and returns
The right of return does not apply to custom-made products. This includes Ylses headboards, furniture, cushions and other products when these have been created especially for you. Services where you have expressly consented to the Service begin without the right of return.
8. Complaints and warranty
All Ylses products undergo a rigorous multi-stage quality control before delivery. If your product was defective or faulty when you received it, please contact us at hello@ylsedesign.se as soon as the defect is noticed, but no later than 48 hours after receipt. Please describe the defect or damage in as much detail as possible and attach pictures of the damage to enable us to assess your case as best as possible. Claims must be submitted within 48 hours after delivery for transport damage. Pursuant to section 2 of these Terms and Conditions, our products are handmade and may vary slightly in appearance.
9. Trademarks and copyright
Please note that your use of this website does not grant you any rights to use our trademarks. All intellectual property rights, such as trademarks and copyright, and in the material published on it (including but not limited to logos, designs and images), on the website and on our marketing channels, including but not limited to Instagram and Pinterest, are owned by Ylse. You are authorized to use this material only for personal, non-commercial purposes. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Ylse.
10. Personal data
We care about your personal data and it is important for us to handle your personal information in a safe and secure way. Ylse collects, processes and controls personal information such as, but not limited to, name, address, phone number, email and IP-address, according to our Privacy Policy. Ylse Design AB is responsible for all personal data that we receive when you visit our website, make a purchase or otherwise contact Ylse. The personal information you provide will be used, among other things, to secure deliveries to you and provide you with offers.
11. Cookies
Ylse uses cookies, pixel tracking and site analytics tools on our website. We do this to understand user behavior, preferences on the site to be able to improve our products, service and user experience. Please read our Privacy Policy for more information. You may at any time reject or delete these cookies and opt out from being tracked by pixels or site analytics.
12. Liability
Ylse’s responsibility for errors in connection to delivery is limited to existing conditions of sale. Ylse bears no direct or indirect responsibility for example, but not limited to, incompatibility, delivery delays, downtime or data loss.
Ylse’s total liability shall under no circumstances exceed the amount paid for the product. Ylse shall not be liable for any indirect, incidental, punitive or consequential damages, including loss of profit.
Ylse cannot be held responsible for any damage caused from using the website. Ylse cannot guarantee a problem-free, uninterrupted, and secure access to the website. The site may contain links to other website beyond our control. We cannot be held liable for any content or privacy policies of such sites.
13. Dispute resolution and governing law
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Sweden. In the event of any disputes, we strive to resolve these in agreement with the customer. Disputes that cannot be resolved can be tried by a public court under Swedish law.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
14. Force majeure
We are not liable for delays or errors due to circumstances beyond our control, such as acts of war, natural disasters, strikes, embargo, sanctions, export restrictions, armed conflict, shipping disruptions, port closures, trade restrictions or other force majeure events.
15. Changes in Terms and Conditions
We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. Any changes will take effect from the date of publication on our website or from the date we informed you of the changes. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

16. Installation and Mounting Disclaimer
All products supplied by Ylse may include general installation guidance and, where applicable, mounting hardware such as screws, plugs, or brackets. Any such hardware and instructions are provided for convenience only.
The mounting hardware included is of a general standard type and may not be suitable for all wall types, structures, or regional building requirements. It is the customer’s sole responsibility to determine whether the provided hardware is appropriate for their specific wall construction and load-bearing conditions.
The customer bears full and sole responsibility for:

Assessing the suitability and structural integrity of the wall or mounting surface;

Selecting and/or replacing mounting hardware as necessary for safe installation;

Ensuring proper and secure installation;
-
Complying with all applicable local building codes and safety regulations;

Engaging a qualified professional installer where appropriate.
Ylse does not guarantee that the included hardware or installation guidance is suitable for every installation scenario.
To the fullest extent permitted by applicable law, Ylse shall not be liable for any damage, injury, structural failure, or loss arising from or related to:

Use of the included mounting hardware;

Installation or mounting of the product;
-
Failure of walls, structures, or mounting surfaces;

Improper installation or misuse;
-
Reliance on installation guidance.
All risk associated with installation and mounting rests solely with the customer upon delivery of the product.
